Terms and Conditions of Weigel’s Auto Spa Membership

The following terms and conditions (the “Terms and Conditions”) create a binding agreement (the “Agreement”) between Weigel Stores, Inc. (“Weigel’s”) and each person or entity that purchases a Weigel’s Auto Spa unlimited membership plan (each an “Auto Spa Membership” or “Membership”).  As used herein, the term “Member” means the person or entity that purchases an Auto Spa Membership from Weigel’s.  By purchasing a Membership, Member agrees to be bound by these Terms and Conditions.

  1. Unlimited Membership Plan.  The Auto Spa Membership entitles a Member to wash its vehicle at Weigel’s Auto Spa locations as many times as Member wishes to do so (i.e., no limit on washes), subject to these Terms and Conditions.
  2. One Vehicle Per Membership; Transfer of Membership.  Each Auto Spa Membership is for one (1) vehicle only and will be assigned a corresponding Member sticker (whether RFID or otherwise) and/or license plate that MUST remain attached to the vehicle for the duration of the Membership. An Auto Spa Membership is NOT transferable from one vehicle to another, or from one Member to another; provided, however, that if a Member purchases a new vehicle to replace the original vehicle covered by the Membership, the Membership may be transferred to the new vehicle, which can be accomplished by stopping by one of the Auto Spa locations and asking a team member to update the Membership.
  3. Family Plan.  Although each Auto Spa Membership is for only one (1) vehicle, Weigel’s offers family plans where up to four (4) additional vehicles can be added to a valid Membership.  Each additional vehicle can be added to the Membership by paying the normal monthly membership fee for the added vehicle minus Ten Dollars ($10.00) (i.e., each vehicle added to a Membership under a family plan receives a $10.00 discount on the normal monthly membership fee).
  4. Vehicle Guidelines.  All vehicles associated with an Auto Spa Membership must meet the Weigel’s Auto Spa’s safety guidelines. It is every Member’s obligation to ensure that its vehicle complies with the safety guidelines, and enrollment of Member into the Membership program does not waive or guarantee Member’s compliance with the safety guidelines.   5. Damage; Liability Limitation; Claims Period.  Weigel’s shall only be responsible for damage to Member’s vehicle that can be proven is directly caused by Weigel’s Auto Spa equipment while the vehicle is being washed, provided that the vehicle meets the Weigel’s Auto Spa safety guidelines, and further provided that Weigel’s will not be responsible if the damage: (i) is caused by the Member’s negligence or misconduct, or the conduct of another Member or customer; (ii) is caused by or involves a pre-existing condition (scratches, dents, etc.) in any way; or (iii) involves an accessory or component (antennas, windshield wipers, roof racks, mirrors, trailer hitches, etc.) of the vehicle. Notwithstanding the foregoing, Weigel’s responsibility or liability for any damage caused to Member’s vehicle by Weigel’s Auto Spa equipment while the vehicle is being washed shall be limited to the total amount of membership fees that the Member has paid over the life of the Membership for the damaged vehicle.  Furthermore, in no event shall Weigel’s be required to pay a Member’s costs, expenses, or attorney’s fees in connection with any claim or lawsuit associated with a vehicle damage claim.
  6. Auto Spa Availability.  Weigel’s reserves the right to close any of its Auto Spa locations at any time in its sole and absolute discretion. Circumstances in which Weigel’s may use this discretion includes but is not limited to inclement weather, power outages, equipment failure, maintenance or upgrades, holidays, and other circumstances that may affect the availability of services.
  7. Promotional Offers. Weigel’s may occasionally run promotional offers for some or all of the Auto Spa locations.  Any Auto Spa promotion offered by Weigel’s will be valid only one (1) time per account. If at any time a Membership is enrolled at a promotional rate, said rate will not be guaranteed to be applied to any additional periods outside of the detailed promotion. In said circumstance, after the expiration of the promotion, regular rates will apply.
  8. A-La-Carte Services.  Weigel’s may offer a la carte items (items available separate from Memberships) at some or all Auto Spa locations from time to time for Members to purchase via a pay station kiosk.  Member agrees that if it chooses an a la carte item, Member is giving Weigel’s permission to charge its credit or debit card on file to process a one-time payment for said a la carte item.
  9. Purchase of Auto Spa Membership.  Auto Spa Memberships may be purchased in person at one of the Weigel’s Auto Spa locations, or online at https://weigelsautospa.com.  All Auto Spa Memberships require a Member to have a valid credit or debit card on file with Weigel’s for payment of the monthly membership fees.  All personal information provided by Member in connection with its purchase of a Membership will be maintained by Weigel’s in accordance with its privacy policy, which is available at: https://weigels.com/privacy-policy/.
  10. Monthly Automatic Renewal.  All Auto Spa Memberships will automatically renew on a monthly basis from the initial Membership purchase date.  The credit or debit card on file will be charged monthly on the renewal date, although this date may vary. Weigel’s reserves the right to retry such monthly charge up to three (3) business days after the renewal date.  In the event the charges are declined by the card issuer, Weigel’s shall be entitled to immediately terminate the Membership as detailed in Section 15 below. If the Membership is terminated for this reason, Member can reactivate the Membership within thirty (30 days, in which event the Membership will be continued at the original membership rate.  If Member fails to renew within said thirty (30) day period, Member will have to purchase a new Membership at the then current membership rate.
  11. MONTHLY CHARGE AUTHORIZATION.  MEMBER ACKNOWLEDGES AND AGREEES THAT BY PURCHASING AN AUTO SPA MEMBERSHIP, IT WILL BE AUTOMATICALLY CHARGED EACH MONTH UNTIL IT CANCELS THE MEMBERSHIP OR THE MEMBERSHIP IS TERMINATED BY WEIGEL’S, AND MEMBER HEREBY AUTHORIZES WEIGEL’S TO CHARGE THE MONTHLY MEMBERSHIP FEES TO MEMBER’S CREDIT OR DEBIT CARD ON FILE.
  12. Increase in Membership Fees.  Member acknowledges and agrees that the monthly fees for its Membership may be increased by Weigel’s at any time in Weigel’s sole and absolute discretion after notice of said increase has been posted at all Weigel’s Auto Spa locations for at least thirty (30) days.
  13. Cancellation. The Auto Spa Membership will remain in effect until Member provides Weigel’s with a timely cancellation notice. All cancellation notices must be received by Weigel’s at least forty-eight (48) hours prior to the monthly renewal date of the Membership.  If the cancellation notice is not given in a timely manner by Member, the Auto Spa Membership will renew for one (1) more month and will terminate on the next renewal date.  Weigel’s reserves the right to modify or cancel any Membership at any time for any reason and without cause upon thirty (30) days’ written notice to Member.  Weigel’s further reserves the right to modify or cancel any Membership immediately for cause, which includes but is not limited to non-payment of membership fees (i.e., a declined credit or debit card charge), membership abuse, inappropriate conduct, and/or safety concerns. No notice is required to be given by Weigel’s if the termination of the Membership is for cause.  Member can cancel its Membership at any time for any reason by providing the previously mentioned notice of cancellation in a timely manner. Notification by Member can be made through its online account, by calling Weigel’s Auto Spa at 865-362-5831, or by emailing Weigel’s Auto Spa at cancellation@weigelsautospa.com.
  14. No Refunds. No refunds will be given for the termination of any Auto Spa Membership, including mid-month terminations.  In addition, no refunds will be given for monthly cycles in which Member does not use any of the Weigel’s Auto Spa locations (i.e., months in which there is no Auto Spa usage).
  15. Management of Membership.  Member can manage its Membership by visiting the Weigel’s Auto Spa website at https://weigelsautospa.com, or by calling Customer Service at 865-362-5831.
